This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 486/2014, registered at Police Station Telibandha, Raipur (C.G.), for the offence punishable under Section 420, 34 of I.P.C.

Case of the prosecution, in brief, is that, present applicant and coaccused person being Director of J.S.T. Homes Private Limited got Rs.18,00,000/- invested promising double the amount and thereby committed offence.

Learned counsel for the applicant would submit that complainants were already receiving interest in the said amount and she has been falsely

implicated in the offence in question. He would further submit that charge sheet has been filed and applicant is in jail since 08/12/2014 therefore she may be released on bail.

On the other hand, learned State counsel would oppose the prayer for grant of bail and submit that 18 criminal cases of identical nature have been registered against the applicant.

I have heard learned counsel appearing for the parties and perused the case diary.

Taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence; role of the present applicant in offence in question; 18 criminal cases have been registered against the applicant and pending consideration, this Court is not inclined to release the applicant on regular bail. 7.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
