1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.165/2015 (Criminal Case No.1272/2015 pending in the Court of Chief Judicial Magistrate, Korba) registered at Police Outpost (Chowki) CSEB, Korba, for the offence punishable under Sections 381 and 409 read with Section 34 of the IPC.
2. Case of the prosecution, in brief, is that the applicant is said to have been found in possession of stolen property of Rs.4,15,740/- allegedly stolen by co-accused persons.
3. I have heard learned counsel for the parties and perused the case diary.
4. Learned counsel for the applicant submits that the applicant has not committed any offence and he has been falsely implicated in the case. The applicant is working as Assistant Lineman in the Chhattisgarh State Electricity Board. He is in jail since 5-4-2015. No useful purpose will be served by keeping him in jail.
5. On the other hand, learned State counsel opposes the application.
6. Taking into consideration the nature and gravity of offence, facts and circumstances of the case and recovery of Rs.20,000/- of stolen amount from the possession of the applicant, I am not inclined to grant regular bail to the applicant. The application is rejected. However, the trial Court is directed to expedite the trial.
