The applicants have filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as they are in custody since 15.02.2018 (applicant T. Rajesh) and 16.02.2018 (applicant A. Ajay) in connection with Crime No.367/2017 registered at Police Station : Saraipali, District Mahasamund (C.G.) for the offence punishable under Section 392/34 IPC.

Learned counsel for the applicants wants to withdraw the present application with liberty to revive the same after main evidence.

State counsel submits that the applicants are accused in
other cases also and it appears that they are in habit of committing such offence.

Be that as it may, the applicants are permitted to withdraw the present application with liberty to revive the same at the appropriate stage.

The application is accordingly dismissed as withdrawn reserving aforesaid liberty.
