1. Heard.

2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.271/2020 registered in Police Station Palari, Balodabazar- Bhatapara C.G. for the offence punishable under Sections 376, 313, 506 of the I.P.C.

3. Case of the prosecution, in brief, is that the prosecutrix aged about 26 years was in contact with the applicant through mobile set provided by him. They keep on calling each other and having sexual relation for

MCRC No. 5586 of 2020 which she became pregnant which was later on got aborted by the applicant. The applicant is a married man and proceedings for obtaining divorce with his wife was going on, therefore, he promised to prosecutrix that as soon as he obtains divorce, he will marry her but later on refused to marry.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering the fact that the prosecutrix is more than 18 years age and appears to have entered into consensual relation for more than a year and further that the applicant is in jail since 20.07.2020 and the charge sheet has already been filed, this Court is inclined to release the applicant on bail.

6. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of ₹50,000/- with one surety for the like amount to the satisfaction of the trial Court.
