This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.77/2015, registered at Police StationMainpur, District-Gariyaband (CG), for the offence punishable under Sections 457 and 380/34 of the IPC.

After hearing learned counsel appearing for the parties and taking into consideration the facts & circumstances of the case, nature & gravity of the offence and the manner in which the applicants have stolen laptop, charger and mobile worth `33,500/- from the house of Benipuri Goswami and subsequent recovery, I do not find any ground for grant of bail to the applicants. Consequently, bail application is rejected. However, the trial Court is directed to expedite the trial and conclude the same as early as possible.
