This is the second bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of temporary bail to the applicant who has been arrested in connection with Crime No. 445/2012, registered at Police Station Bhilai Nagar, District Durg (C.G.), for the offence punishable under Sections 363, 366 and 376 of I.P.C.

Learned counsel for the applicant submits that father of the applicant namely K. Ashok Kumar is employee of Bhilai Steel Plant and is suffering from Subante Intestinal Obstruction with abdominal Mass HT, Seizure Disorder with CVT and has been referred by Jawaharlal Nehru Hospital & Research Centre to the Christian Medical College, Vellore, Tamil Nadu by order dated 09/07/2015 and he was given appointment on 24/07/2015 and accordingly admitted at Christian Medical College, Vellore, Tamil Nadu by his neighbor and there is no one to look after his ailing father
except the applicant therefore, temporary bail for a period of one month be granted.

On the other hand, learned counsel for the State opposed the prayer.

I have heard learned counsel appearing for the parties. 5.
Taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence; and particularly considering illness and documents filed viz., referral order dated 09/07/2015 that father of the applicant is suffering from Subante Intestinal Obstruction with abdominal Mass HT, Seizure Disorder with CVT, this Court is of the opinion that present is a fit case in which the applicant should be enlarged on temporary bail for a period of one month. 6.
It is directed that the applicant shall be released on temporary bail for a period of one month on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court.

Applicant be released immediately and he shall surrender before the trial Court on 31/08/2015 without fail.

With the aforesaid observation, the second temporary bail application is disposed of.
