1. Learned counsel for the petitioner submits that the petitioner stood retired on 29-2-2016 from the services of Chhattisgarh State Agriculture Marketing Board, Telibandha, Raipur. It is further submitted that the petitioner has not been paid gratuity under the Payment of Gratuity Act, 1972 on the ground that one departmental enquiry is pending against him. He would further submit that the petitioner is ready and willing to take part in the departmental enquiry, however, the same may be directed to be concluded within stipulated time and thereafter
whatever the gratuity amount is payable, may be released in favour of the petitioner as he stood retired on 29-2-2016. He would further submit that the petitioner has already filed a representation to respondent authorities, but the same remained undecided, therefore, the respondent authorities may be directed to consider and decide the same within stipulated period.
2. Perusal of the document (Annexure P/1) would show that the petitioner has been asked to appear in the departmental enquiry.
3. Considering the fact that since the petitioner stated that he would appear in the departmental enquiry, it is directed that the petitioner may do so. The departmental enquiry, if so, is pending against the petitioner, the same may be concluded within a period of four months from the date of receipt of a copy of this order after giving an opportunity of hearing to the petitioner and thereafter gratuity amount of the petitioner may be settled accordingly.
4. With the aforesaid observation/direction, the writ petition stands disposed of.
