This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.23/2016, registered at Police Station-Sirgitti, District-Bilaspur (CG), for the offence punishable under Section 304B of the IPC.

Case of the prosecution, in brief, is that wife of the applicant committed suicide on account of cruelty and demand of dowry made by the present applicant.

Learned counsel for the applicant would submit that the applicant has not committed any offence and he has falsely been implicated in crime in question. He is in jail since 14.1.2016 and charge-sheet is yet to be filed.

On the other hand, learned State counsel would oppose the bail application.

I have heard learned counsel for the parties and perused the case diary.

Taking into consideration the facts & circumstances of the case, nature & gravity of the offence and the fact that marriage took place between the applicant and the deceased on 28.11.2015 and the deceased committed suicide on 21.12.2015 i.e. within one month of the marriage, I am not inclined to release the applicant on regular bail. Consequently, bail application is rejected. However, the trial Court is directed to expedite the trial and conclude the same as early as possible. Sd/- (Sanjay K. Agrawal) JUDGE B/-
