At the outset, learned counsel for the applicant submitted that the original record of the Sessions Trial No.60/2010 of the First Additional Sessions Judge, Mahasamund, C.G. has been called by this Court in Criminal Appeal No.842/2014 (Jagdish and another Vs. State of C.G.); and as the present applicant is also a co-accused in the same sessions trial, his trial could not be started as the original record has been called. Learned counsel for the applicant further submitted that the learned trial Court also prayed that the original record be sent for trial of the present applicant. Learned counsel for the applicant prayed that he be permitted to file an application in the criminal appeal No.842/2014 with a prayer to return the original record to the trial Court for trial of the present applicant.

As prayed, the instant Cr.M.P. is disposed reserving the aforesaid liberty if available under the law.

The petition disposed of.
