1. The applicant has preferred this application under Section 439 of Cr.P.C. as he is in jail since 02.01.2019 in connection with Crime No. 01/2019 registered in Police Station- Baghnadi, District Rajnandgaon (CG) for the offence punishable under Sections 302 & 201 of IPC.

2. At the very outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to pray before the trial Court to expedite the trial and if the trial is not completed within time, an opportunity will be given to him to file a fresh application as and when occasion arises.

3. Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
