This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants who have been arrested in connection with Crime No.2/2015, registered at Police Station-Pendra, District-Bilaspur (C.G.), for the offence punishable under Sections 457 and 380/34 of the IPC.

Case of the prosecution, in brief, is that, the present applicants are said to have stolen computer from the High School, Dhobhar and thereby committed the aforesaid offence.

Learned counsel for the applicants would submit that applicants
have not committed any offence and have been falsely implicated in the case. He would further submit that the applicants are in jail since 31.5.2015 and there is no evidence against the present applicants to connect them in crime in question.

Learned State counsel would oppose the prayer for grant of bail. 5.
I have heard learned counsel appearing for the parties and perused the case diary.

Taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence and recovery of computer from the possession of the present applicants, this Court is not inclined to release the applicant on regular bail. 7.
Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
