1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 13.06.2021 in connection with Crime No. 81/2021 registered in Police Station- Udaypur, District Sarguja (CG) for the offence punishable under Section 376 (2 (n) of IPC.

2. On 16.08.2021, at the request of learned counsel for the applicant, this Court had granted four weeks time to counsel for the applicant.

3. Today, none appeared on behalf of the applicant even in the second round.

4. In these circumstances, this Court is left with no other option but to dismiss the bail application for want of prosecution. Accordingly, the bail application is dismissed for want of prosecution.
