A limited prayer by the Petitioners in this Cr.M.P. is for deleting the observations made by this Court in paragraph 9 of the order dated 19.6.2014 in M.Cr.C.(A) No. 197 of 2014.

Counsel for the Petitioner relies upon the decision of the Supreme Court in the case of Siddharam Satlingappa Mhetre v. State of Maharashtra & others (2011 (1) SCC 694).

Keeping in view of the order passed by the Supreme Court in the aforesaid judgement, this Court is of the opinion that the observations made by this Court in paragraph 9 of the order dated 19.6.2014 while disposing of M.Cr.C.(A) No. 197 of 2014 was uncalled for and the same stands deleted from the said order.

The impugned order dated 19.6.2014 be read without the observations made in paragraph 9.
