1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.197/2015, registered at Police Station Newra, Distt. Raipur for the offence punishable under Sections 363, 364A, 365 and 419 read with Section 34 of the IPC.
2. Case of the prosecution, in brief, is that the applicant along with other co-accused persons kidnapped and abducted a minor child of one Vidyut Adhikari aged about 18 months for a ransom of Rs.2 crores, and thereby committed the offence.
3. Learned counsel for the applicant submits that the applicant has not committed any offence, he has been falsely implicated in the case and he is in custody since 10-8-2015. He further submits that the minor child was kidnapped by Durga Wasni and Mangla Wasni.
Charge-sheet has been filed.
4. On the other hand, learned State counsel opposes the bail application and submits that the present applicant is the master mind behind the crime and therefore, he is not entitled to be released on bail.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the facts and circumstances of the case, taking into consideration the nature and gravity of offence, role of the present applicant, conspiracy of the present applicant with other co-accused, demand of ransom of Rs.2 crores and the manner in which 18 months' child has been kidnapped for ransom of Rs.2 crores, I am not inclined to grant bail to the applicant. Consequently, the application is rejected.
