Heard Learned counsel for the applicant seeks permission of this Court to withdraw the instant bail application filed under Section 438 of Cr.P.C. with liberty to the applicant to surrender himself and apply for regular bail before the concerned trial Court on the same day.
Accordingly, the anticipatory bail application is dismissed as withdrawn with the aforesaid liberty. However, the applicant, if so advised, may surrender and apply for regular bail before the concerned trial Court and if such application is filed, the concerned trial Court shall consider and decide the same on merits as early as possible.
