Learned Counsel for the Petitioner submits that in fact the present criminal miscellaneous petition has become infructuous on the ground that the original proceedings under Section 125 Cr.P.C. itself has been finally decided by the Judicial Magistrate First Class, Bacheli against which the Petitioner has already preferred a revision and which is pending consideration.

Learned Counsel for the Petitioner prays that the present petition may be dismissed as having become infructuous and the grounds taken in the present petition may be permitted to be raised in the revision petition which is filed against the order passed in the petition under Section 125 Cr.P.C.
