(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 140/2015 registered at Police Station Chirmiri, District Korea for the offences punishable under Sections 420, 468, 468 & 471 of the Indian Penal Code. (2) Case of the prosecution, in brief, is that applicant obtained 6,00,000/- from the complainant on 16.8.2012 for depositing the same in ₹ the reputed company known as Signing India Real Estate & Deris Limited to get the higher interest on it and thereby cheated the complainant. (3) Counsel for the applicant submits that applicant has been falsely implicated in the offence in question as he has not committed any offence and the complainant has turned hostile and, therefore, the applicant may be released on bail.
(4) Taking into consideration the facts & circumstances of the case and the manner in which the huge money has been obtained by the applicant from the complainant on the false promise; I am not inclined to release the applicant on bail.
