This M.C.C. has been preferred by the petitioner for modification of order dated 16.08.2017 passed by this Court in Writ Petition No. 403/2006. 2.

Learned counsel appearing on behalf of petitioner would submit that as per the new rules of 'Chhattisgarh Audyogik Bhumi Evam Bhawan Prabandhan Niyam 2015' the appeal would lie to the State Government and not to the Chairman (CSIDC) and, therefore, the order passed by this Court on 16.08.2017 be modified.

I have heard learned counsel for the petitioner. 4.

After hearing learned counsel for the petitioner, I am of the opinion that the old rule as existed in the year 2006 would be applicable and as such no modification is required in the order passed by this Court on 16.08.2017. 5.
