1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No.291/2020 registered at Police Station Kota, Police Outpost Belgahna, Distt. Bilaspur (Chhattisgarh for the offences punishable u/ss 34(2), 42, 59-A of Chhattisgarh Excise Act.

2. As per the prosecution case, 190 bulk litres of liquor was seized from Komeshwar and Vedenta and the vehicle of the present applicant was used in transportation of the illicit liquor. Subsequently when the applicant appeared to get the possession of the vehicle before the Court, he was arrested on 23.07.2020.

3. Learned counsel for the applicant submits that the applicant was not named in the FIR, however, he was subsequently arrested. He further submits that the applicant is in jail since 26.07.2020 and he may be released on bail.

4. On the other hand, learned State Counsel opposes the bail application.

5. Considering the facts situation of the case and the nature of involvement of the present applicant and the fact that he is in jail since 26.07.2020, I am inclined to allow the bail application.

6. Accordingly, this application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
