2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.139/2020 registered at Police Station Gariyaband, District Gariyaband (CG) for the offence punishable under Sections 341, 307 of the IPC.
3. The applicant was having an affair with Yamini Sahu, however,
MCRC No. 5596 of 2020 she was married to injured Sunil Sahu, where-after, she discontinued her affair with the applicant, but the applicant insisted to continue the relationship and in that sequence, he restrained Yamini Sahu and her husband, when they were approaching towards their village Tawarbahara at about 6.30 p.m. on 7.7.2020. In the quarrel, which took place between the applicant and Sunil Sahu, the applicant inflicted injuries on the abdomen, hand and arm of Sunil Sahu by means of knife. Even though the applicant also appears to have sustained injuries as is appearing in the photograph-Annexure A-2, the fact remains that the applicant wanted to continue his affair with Yamini Sahu despite her marriage with Sunil Sahu.
4. Therefore, considering the genesis of the offence and the set up, in which, the entire incident took place as also for the fact that amongst others, the injuries have been caused on the abdomen by knife, I am not inclined to release the applicant on regular bail.
5. The bail application is dismissed.
