1. Heard.

2. These are the applications filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail to the applicant, who is apprehending his arrest in connection with Crime Nos.485/2020, 487/2020, 486/2020 & 484/2020 registered at Police Station City Kotwali, Balodabazar, District

Balodabazar-Bhatapara (CG) for the offence punishable under Sections 420, 34 of the IPC.

3. The applicant has defrauded the complainants of different amounts by promising them to arrange employment but neither the employment was arranged nor the amount has been returned.

4. In MCRCA No.1080/2020, the applicant and other co-accused persons have obtained Rs. 14 lakhs, whereas, in MCRCA No.1082/2020, they have received Rs.1.5 lakhs. In MCRCA No.1134/2020, they have received Rs.2.5 lakhs and in MCRCA No.1145/2020, they have received 2.5 lakhs.

5. Considering the nature of allegations, it seems custodial interrogation of the applicant would be needed and therefore, I am not inclined to extend the benefit of Section 438 of Cr.P.C. to the applicant.

6. Accordingly, the applications are dismissed. In the event of surrender and the applicant applies for regular bail, the same shall be considered expeditiously by the jurisdictional Court. Sd/- (Prashant Kumar Mishra) Judge Shyna
