1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.54/2014, registered at Out Post Wadrufnagar, Police Station Basantpur,, Distt. Balrampur-Ramanujganj, for the offence punishable under Sections 457 and 380 of the IPC.

2. Case of the prosecution, in brief, is that the applicant and two other co-accused persons were found to have stolen the valuable articles from the house of one Kedarnath Yadav in the intervening night of 236-2014 and 24-6-2014 and thereby committed the offence.

3. Learned counsel for the applicant submits that the applicant has not committed any offence and he has been falsely implicated.

4. On the other hand, learned State counsel opposes the application.

5. I have heard learned counsel for the parties and perused the case

diary.

6. Taking into consideration the nature and gravity of offence, facts and circumstances of the case, considering the fact that the accused/ applicant remained absconding for last four years and the material available on record, I do not find any case for grant of bail to the applicant. The application is accordingly, rejected. However, the trial Court is directed to expedite the trial and conclude the same expeditiously.
