The present contempt petition has been filed alleging non compliance of the order dated 02.01.2019 passed in WPS No.8363 of 2018.

The document enclosed with the writ petition would show that the representation of the petitioner has since been decided by the respondent No.2 vide order dated 18.02.2019 (Annexure C-3). Since the direction was only to decide the claim of the petitioner and the respondents have decided the same holding that the petitioner is not entitled for the benefit sought for, this court is of the view that the order passed by this court stands duly complied with. In case, if the petitioner is aggrieved of the same, the petitioner would have the right and liberty to challenge the subsequent order by way of fresh proceedings. The veracity of the said order dated 18.02.2019 cannot be tested under the contempt jurisdiction. Accordingly, reserving the right of the petitioner to assail the subsequent development, the present contempt petition stands disposed of.
