1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.370/2015, registered at Police Station Aarang, Distt. Raipur, for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act, 1915.
2. Case of the prosecution, in brief, is that the applicant was found in possession of 240.920 bulk liters of illicit liquor.
3. Taking into consideration the nature and gravity of offence, facts and circumstances of the case, quantity of liquor i.e. 240.920 bulk litres and in view of the provisions contained in Section 59-A(ii) of the Chhattisgarh Excise Act, 1915, I am not inclined to grant bail to the applicant. The application is rejected.
