1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 13.07.2021 in connection with Crime No.423/2021 for offence under Section- 34 (2), 59 (A) of C.G. Excise Act, registered at Police Station- Kharsia, District- Raigarh (C.G.).

2) Learned counsel for the applicant submits that two bail applications arising out of same crime number of the same accused have been filed, therefore, he wants to withdraw the bail application i.e. MCRC No. 5289 of 2021.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.
