2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.232/2019 registered at Police Station Janjgir, District Janjgir-Champa (CG) for the offence punishable under Sections 419, 420, 467, 468, 34 of the IPC.

3. The applicant along with co-accused Toshan obtained loan of

Rs.5,16,930/- from the Corporation Bank, Janjgir under Kisan Credit Scheme. To obtain the loan, mortgage was created by using the property documents of Arjun Singh and Sarju Singh, however, Arjun Singh having already died, this applicant impersonated him, whereas, co-accused Toshan impersonated Sarju Singh, brother of Arjun Singh. Third accused Dileep stood third witness to the mortgage transaction.

4. Considering the fact that the applicant is in jail since 4.5.2019 and the charge sheet has already been filed as also for the reason that the offences are triable by the Judicial Magistrate First Class, this Court is inclined to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
