This is first bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested on 16-4-2019 in connection with Crime No. 262 of 2019 registered at Police Station Civil Lines, Bilaspur (CG), for the offence punishable under Sections 294, 506, 323 & 327 of IPC.

Case of the prosecution is that the applicant demanded 10,000/- from complainant Ramesh Patel on 15-4-2019 and assaulted him for non-fulfillment of demand and thereby the aforesaid offence was committed.

Learned counsel appearing for the applicant would submit that the complainant has been examined by the trial Court but he has not supported the version of prosecution. He would

further submit that the applicant is in jail since 16-4-2019, therefore, he may be released on bail.

On the other hand, learned State counsel opposes the application for grant of bail.

I have heard learned counsel for the parties and perused the case diary.

Taking into consideration that the complainant has not supported the version of prosecution and further taking into consideration that the applicant is in jail since 16-4-2019 and trial will take for some time, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and it is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.20,000/- with one local surety in the like amount to the satisfaction of the concerned trial Court. He shall appear before the trial Court regularly on each and every date, unless exempted from appearance.
