1. Apprehending arrest in connection with Crime No. 163/2015 registered at Police Station Sirgitti, Distt. Bilaspur (C.G) for the offences punishable under sections 420, 201/34 of IPC read with Sections 3 & 4 of Chit Fund Act.
2. As per the prosecution case, the applicant along-with his mother and sister used to play BC (Chits) and collected money from different persons and thereafter he has not paid back the amounts. Consequently reports were made by few of the persons to the I.G., Police which was subsequently forwarded to S.P., and a case was registered.
3. Learned counsel for the applicant submits that the applicant is no where involved in this case and the entire crime has been committed by his mother and sister who have been arrested and have been in jail. He further
submits that only bald allegations have been made against him, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the prayer for grant of bail. He read out the written complaints made by Razia Khan, Meena Tandon, P. Ramanna and submits that this applicant along with his mother and other coaccused have actively involved in playing B.C., and collecting amounts, therefore, the allegations have been levelled against this applicant. He further submits that the charge sheet has been filed and the applicant is absconding.
5. Perused the case diary and the written reports where in this applicant has been named.
6. Considering the fact that the applicant has been named in the written reports and he is still absconding and the charge sheet has already been filed, I am of the opinion that it is not a fit case where the provisions of section 438 Cr.P.C., can be extended. Accordingly, this application is rejected.
