Order On Board 03/09/2015 Today, learned State counsel produced before this Court, copy of letter dated 31/08/2015 by which, letter of invocation of bank guarantee earlier issued on 01/08/2015 has been withdrawn reserving right to act afresh for invocation of bank guarantee at any time as required.

Learned counsel for the petitioner submits that in this situation, the petition may be disposed off reserving liberty to the petitioner to approach this Court again in case, the respondents proceed against them in the matter of invocation of bank guarantee.

Learned State counsel submits that the petitioner may approach the concerned authorities and authorities will take suitable steps for appropriate final settlement of the bill as early as possible.

In view of the above submission and subject to the condition that the petitioner shall extend the period of validity of bank guarantee initially for a further period of three months, the petition is finally disposed off. The undertaking given by the counsel for the petitioner that the bank guarantee would be extended from time to time, if required, before settlement takes place, is also placed on record.
