This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No. 37/2016 registered at Police Station Dharamjaigarh, Distt. Raigarh (C.G.) for offence punishable under Section 186, 294, 509, 448/34 of Indian Penal Code and Section 3(i)(xi) of the Scheduled Caste, Scheduled Tribe (Prevention of Arocities) Act, 1989.

As per the prosecution case applicant along with other co-accused entered into the room of the complainant Geeta Darshan who is Project Officer in Angan Badi and stated that they are reporter for the tribal column in the paper and demanded Rs.5000/- as otherwise it was stated that they will publish news against her. On being refused paper publication was made.

Learned counsel for the applicant submits that publication was made in paper namely Adivasi Stamb and thereafter a report has been made against this applicant and false allegations have been made, therefore the applicant may be granted benefit of anticipatory bail.

Learned State counsel opposes the prayer for grant of anticipatory bail.

I have perused the case diary and the statement as also report made by Project Officer Akikrit Bal Vikas Pariyojna wherein it is stated that Rs.5000/- was demanded which was refused and subsequently Rs.5000/- was demanded on 20/01/2016 and after refusal a report was published on 28/01/2016 in the paper. Taking into allegation of report, I am not inclined to extend benefit of anticipatory bail to the applicant. 6.
Accordingly, the anticipatory bail application is dismissed. Certified copy as per rules.
