1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 391 of 2014 registered at P.S. Manendragarh (C.G) for the offence punishable under Section 420, 380, 467, 468, 471/34 of IPC.
2. The prosecution case, in brief, is that the applicant while working as Junior Executive in Divisional Forest Office, Manendragarh had stolen the transit pass and has issued it to one Gopal Krishna for the purpose of transporting forest produce on 01.11.2014.
3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and he has not committed any offence. He further submits that the applicant has left the job in forest department in the month of April, 2014 and he has not issued the forged transit pass to the said person Gopal Krishna. It is also submitted that the charge sheet in this case has been filed and the applicant
is in jail since 19.11.2015, therefore, he may be enlarged on regular bail.
4. On the other hand, learned State Counsel opposes the bail application.

Taking into consideration the facts and circumstances of the case; nature & gravity of the offence; the role of the present applicant and his pretrial detention as he is stated to be in jail since 19.11.2015 as also the fact that the charge sheet has already been filed, this court is of the opinion that present is a fit case to enlarge the applicant on bail.
6. Accordingly, the application filed u/s 439 Cr.P.C., is allowed.
7. It is directed that the applicant shall be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. He shall also appear before the trial Court as and when directed by the said Court till disposal of the trial. C.c. as per rules.
