Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 15/11/2017

1. The order Annexure P-1 is assailed on the ground that by order dated 14.08.2017 the petitioner who is working as AG-II was transferred from Janpad Panchayat Ramchandrapur, District Balrampur to Tahsil Ramanujganj, District Balrampur at his own request, however, he has now been directed to work in the Office of District Electoral Officer whose Headquarter is at Balrampur.

2. Considering the entire facts situation of the case, it

appears that the petitioner was posted at his own request to Tahsil Ramanujganj, his posting at Balrampur by the impugned order amounts to change of place of work, which is stated to be located at a distance of 40 K.M. from Ramanujganj.

3. Let the petitioner prefer representation within a period of 04 weeks from today and thereafter, the concerned competent authority shall consider and decide the same within the next 8 weeks, in accordance with law and on its own merits.

4. For a period of 12 weeks or till the representation is decided, whichever is earlier, the status quo, as it exists today, in respect of the petitioner's posting, shall be maintained.

5. The writ petition is accordingly disposed of.

6. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
