09.07.2019 Shri AS Kachhwaha, Advocate for the petitioner. Challenge in this petition is to the order dated 01.02.2019 passed by the Controlling Authority under the Payment of Gratuity Act, 1972 (in short, the Act, 1972).

Prima facie this court is of the opinion that the order under challenge is an appealable order under Section 7(7) of the Act, 1972, and as such the petition becomes not maintainable in the light of there being a statutory alternative remedy available to the petitioner. Accordingly, reserving the right of the petitioner to avail other remedy available to him in accordance with law, the present writ petition stands rejected as not maintainable.
