1. Heard.

2. The prosecutrix is appearing through the help desk of DLSA, Rajnandgaon.

3. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.161/2020 registered at Police Station Chhuikhadan, District Rajnandgaon

MCRC No. 5420 of 2020 (CG) for the offence punishable under Sections 363, 366, 376 of the IPC and Sections 4, 6 of the Protection of Children From Sexual Offences Act, 2012.

4. The prosecutrix, aged about 15 years, was working as maid servant in the house of the applicant. During such engagement of the prosecutrix, the applicant committed forcible sexual intercourse against the prosecutrix on promise to marry.

5. Considering the nature of allegations and the age of the prosecutrix, I am not inclined to release the applicant on bail at this stage.

6. Accordingly, the bail application is dismissed with liberty to the applicant to revive the prayer after examination of the prosecutrix.
