This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 428/15, registered at Police Station Sarkanda, Bilaspur, for the offence punishable
under Sections 454, 380/34 of IPC.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; nature and gravity of offence; the manner in which property worth Rs. 3,92,000/- is said to have stolen from the complainant- Vijay Khare and consequent part recovery of the same from the possession of the present applicant, this Court is not inclined to release the applicant on regular bail. 3.
Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
