1. The applicant is arrested in connection with Crime No.56/2020 registered in Police Station - Urga, District -Korba (CG) for alleged commission of offence under Sections 420, 409 read with Section 120-B and 34 IPC.

Case of the prosecution, in brief, is that various complaints were lodged in the police station by different complainants including complainant of the present case that the applicant and co-accused had invited applications for providing job at Shree Hospital Nursing and Paramedical College, Urga and after having received applications, huge amount was collected by the present applicant and other connected accused from different complainants. In the present case, allegation is that Rs.40,000/- was taken from the complainant in the name of providing job.

3. Learned counsel for the applicant would submit that as far as present

-2applicant's case is concerned, the offence has been registered on the basis of complaint of one Rehana Khan, but, she has given an affidavit that applicant has no involvement and no money was paid to the present applicant. He would next submit that in respect of allegation made by another complainant in Crime No.189/2020, concerning the same place and assurance of job in the same hospital, bail application of present applicant has already been allowed vide order dated 25.9.2020 passed in MCRC No.5413 of 2020.

On the other hand, learned counsel for the State opposed the bail application by submitting that the present applicant is involved in large number of such cases of cheating where applications were invited in the name of providing job in Shree Hospital, Urga, and huge amount was collected not only from the complainant in the present case, but from number of persons desirous to get job.

Taking into consideration the submissions made by learned counsel for the parties, particularly taking into consideration the submission that the present applicant is not involved in taking money from complainant Rehana Khan, considering that investigation is complete and charge she has also been filed and that in identical case, in respect of other complaint of similar nature, the applicant has already been granted bail vide order dated 25.9.2020 in MCRC No.5413/2020, I am inclined to grant bail to the present applicant also.

6. The application is accordingly allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- along with one local surety for the like amount to the satisfaction of the concerned trial Court with following further conditions:- (i) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial; and (ii) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
