Agrawal Order On Board 20/11/2017 (1) Learned counsel appearing for the petitioner would submit that the petitioner' application for issuance of permanent caste certificate has been rejected by the respondent No.2 on 20.06.2017 without considering the material available on record, therefore the impugned order deserves to be set aside.
(2) Learned counsel appearing for the State would submit that the impugned order is appealable under Section 5 of the Chhattisgarh Scheduled Castes, Scheduled Tribes and Other Backward Classes (Regulation of Social Status Certification) Rules, 2013 before the Appellate Authority.
(3) Be that as it may, the petitioner is directed to prefer an appeal before the Appellate Authority under Section 5 of the Chhattisgarh Scheduled Castes, Scheduled Tribes and Other Backward Classes (Regulation of Social Status Certification) Rules, 2013. If such appeal is filed by the petitioner, in that event the Appellate Authority shall consider and decide the same expeditiously preferably within a period of 30 days from the date of receipt of appeal. (4) With the aforesaid observation, the writ petition stands finally disposed of. No order as to costs.
