For Petitioners :

For Respondent-State :

Shri Shashank Thakur, Govt. Advocate.

Hon'ble Shri Justice P. Sam Koshy Order on Board 26.06.2018 1.

The grievance of the petitioners in these petitions is that inspite of there being an order so far as the change of place of posting having been issued as early as on 28.04.2018, the respondents have not relieved the petitioners from their present place of posting. 2.

On the previous date of hearing the State counsel was directed to seek instructions as to why the petitioners could not be relieved inspite of order of place of posting being modified. 3.

Today, on instructions, the State counsel makes a submission that the Collector, Kondagaon, have expressed his inability to relieve the petitioner from Kondagaon to Bilaspur on account of shortage of manpowers and he is waiting for appropriate substitution so that the petitioner can be relieved. The State counsel further submits that perhaps it is the same reason prevailing in the other districts also though he has not received any instruction.

4.

Given the said facts and circumstances of the case and the instructions received by the State counsel, this court does not intend to keep these petitions pending any further. Accordingly, all the petitions stand disposed of with a direction to the respondent No.2the Commissioner, Land Record to ensure providing necessary

substitution for the petitioners at their respective place where they are presently posted so that they can be relieved. 5.

It is expected that the respondent No.2 shall pass necessary order within a period of 45 days from the date of receipt of certified copy of this order.
