This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants who have been arrested in connection with Crime No.213/2012, registered at Police Station-Akaltara, District Janjgir-Champa (C.G.), for the offence punishable under Sections 379 and 411/34 of the IPC.

I have heard learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence and the manner in which the applicants are said to have stolen the property held by CCI, Akaltara and stolen property has been recovered from the possession of the present applicants, this Court is of the opinion that present is not a fit case, in which, the applicants

should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected.
