This is the second bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.291/2014, registered at Police Station-Khairagarh, District Rajnandgaon (C.G.), for the offence punishable under Sections 302 and 307/34 of the IPC. 2.
A bare perusal of the case would show that statements of the accused persons under Section 313 of the CrPC have already been recorded and thereafter, after hearing the parties, the case was closed for judgment, but before the delivery of judgment, on 27.7.2015 an application under Section 311 of the CrPC was filed by the prosecution and that was ultimately granted by an order dated 20.8.2015 and now the case is fixed for 26.9.2015 pursuant to the said order for recording evidence of the investigating officer.

Since the case is on advance stage and almost it has been concluded except further evidence of re-examination of the investigating officer, I do not find any ground for entertaining this second bail application. However, the trial Court is directed to conclude it expeditiously and directed not to adjourn the case unnecessarily.

With the aforesaid direction, the second bail application stands disposed of.
