For Non-Applicant : Shri Salim Kazi, Deputy AG Hon'ble Smt. Justice Rajani Dubey Order On Board 24/05/2019 :

1. The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.77/2019 registered in Police Station Bhatgaon, District Balodabazar Bhatapara for offence under Section 20 b (ii) of the NDPS Act.

2. Case of the prosecution is that on secret information, a raid was conducted by the police on 2.5.2019 wherein the applicants were found to be possessing 4 packets of contraband (Ganja) amounting to Rs.14,000/-.

3. Learned counsel for the applicants would submit that the applicants are innocent and have been falsely implicated in the present offence.

Quantity of seized contraband is very small.

4. Learned State Counsel would oppose the prayer for grant of bail to the applicant.

5. Looking to the quantity of contraband seized from possession of the applicants, this Court is inclined to release the applicants on bail.

6. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
