Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 2 3 / 11 /201 Learned counsel appearing for the petitioner would submit that the petitioner may be allowed to avail the remedy before the District Judge under Section 34 of the Arbitration and Conciliation Act, 1996 (for short "Act, 1996') for setting aside impugned award. 2.

Prayer appears to be fair & reasonable and accordingly the same is allowed.

Be that as it may, the petitioner is at liberty to move application before the District Judge for setting aside impugned award and in that event the District Judge shall consider and decide the same strictly in accordance with law on its own merit.

With the aforesaid observations, the writ petition stands finally disposed of.

Certified copy of the impugned order and other relevant documents be returned to the counsel for the petitioner, after furnishing an attested photocopy thereof.
