Hon'ble Shri Justice Chandra Bhushan Bajpai Order On Board 04.02.2016.

At the outset, learned counsel for the petitioner submits that as the matter is fixed for arguments before the charge on 06.02.2016 before the trial Court, present Cr.M.P. may be dismissed as withdrawn reserving liberty to the petitioner to raise all the related issues of the instant Cr.M.P. before the trial Court at the time of hearing on arguments before charge. Further it is prayed on behalf of the petitioner that he may also be given liberty to approach this Court under the relevant provisions of Section 482 of the Cr.P.C. again if occasion so arises. Further prays that the trial Court shall decide the issues raised, under the provisions of Chapter XIX Section 239 of the Code of Criminal Procedure.

As prayed, the instant petition is dismissed as withdrawn without any appreciation on its merits reserving aforesaid liberty as submitted on behalf of the petitioner.
