1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.265/2015, registered at Police Station Arjuni, Distt. Dhamtari, for the offence punishable under Section 394 of the IPC.
2. The applicant is a juvenile. Therefore, he is required to file application before the Juvenile Justice Board under the provisions of the Juvenile Justice (Care and Protection of Children) Act and as such I do not find it a fit case to entertain this application under Section 439 of the CrPC. The application is accordingly rejected. However, he is at liberty to move an application for grant of bail under the provisions of the Juvenile Justice (Care and Protection of Children) Act before the Juvenile Justice Board.
