This is third bail application under Section 439 of the Cr. P.C. for grant of temporary bail to the applicant who has been arrested in connection with Crime No. 20/2011, registered at Police Station Chhawni, Distt. Durg (C.G.), for the offence punishable under Sections 365, 302 & 386 of the Indian Penal Code.

Learned counsel for the applicant would submit that applicant's sister's marriage is to be solemnized on 24.02.2016 at Durg, therefore, he may be released on temporary bail.

On instructions, learned counsel for the State would submit that applicant's sister's marriage is to be solemnized on 24.02.2016.

I am of the considered opinion that applicant is entitled to participate in the marriage of his sister, Superintendent of Central Jail, Durg is directed that applicant will be sent to the place of marriage on 24.02.2016 in police custody and will be brought back in police custody on 25.02.2016 to Central Jail, Durg. It is further directed that applicant will bear all expenses as per rules.

With the aforesaid observation, third bail application is finally disposed off.
