Mr. Sameer Behar, Panel Lawyer for the State. This is a second bail application for grant of anticipatory bail. First bail application was dismissed on merit vide order dated 09-12-2015 passed by this court in M.Cr.C.(A) No. 1257of 2015.

At the out set, Mr. B.D. Guru, learned counsel appearing for the applicant would submit that he seeks to withdraw the bail application with liberty to move an application under Section 439 of Cr.P.C., before the trial Court. Prayer is just and reasonable, therefore, permission is granted.

Accordingly, the instant bail application is dismissed as withdrawn with the aforesaid liberty. If the applicant moves an application under Section 439 of Cr.P.C., before the competent Criminal Court, the same shall be decided in accordance with law expeditiously.
