For Petitioner :
Mr. Jeet Patel, Advocate For State :
Mr. Mateen Siddiqui, Dy. AG For Hon'ble Shri Justice P. Sam Koshy Order on Board 06/10/2020
1. The limited grievance that the petitioner has in the present writ petition is to th extent that respondent No.5 is not deciding the application moved by the petitioner for entering their names in the revenue records on the property in which petitioners also are share holders on the death of Late Sadhram who died on 26.07.2014.
2. Counsel for the petitioner submits that initially respondent No.5 had not entered the name of the petitioners in the records against which the petitioners had approached the Sub Divisional Officer (Revenue) Sakti, District Janjgir Champa who has passed the order in favour of the petitioner on 17.04.2017. However, thereafter respondent No.5 has not reconsidered his decision in the light of the order passed by the SDO on 17.04.2017. The limited prayer that the petitioner makes at this juncture is that, let respondent No.5 be directed to take an early decision for entering the names of the petitioners also in the revenue records as share holders to the property of Sadhram who died on 26.07.2014.
3. Considering the limited grievance that petitioner has raised and also taking note of the order passed by the SDO (Revenue) Sakti District Janjgir Champa dated 17.04.2017, the writ petition at this juncture stands disposed of directing the respondent No.5 to take an early decision on the application which the petitioners have moved for entering their names in
the revenue records in accordance with law after granting a fair opportunity of hearing to the concerned parties.
4. Let a decision be taken at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.
5. It is made clear that this Court has not expressed any opinion on the claim of the petitioner.
6. With the aforesaid observations, the present Writ Petition stands disposed of.
