Learned counsel for the applicant submits that accused of the case Shri Bhupendra Singh (applicant in WPCR No. 172/2015) filed this petition suppressing the fact that on the allegations of misuse of liberty, the applicant herein (victim) has already applied of cancellation of appeal which was pending before the Court in case No. Cr MP. No. 953/2014 on the date when writ petition of Bhupendra Singh was disposed of by this Court on 13.08.2015. He submits that the non-applicant/respondent no. 1 is now making attempt to somhow get the criminal case closed before there is any decision on petitioner's application for cancellation of bail.

As far as merits of application for cancellation of bail is concerned, the same is pending consideration before this Court, therefore, I am not inclined to make any comment on the same.

Direction by this Court on 13.08.2015 is only for expeditious disposal of trial and it will not have any effect or impact on applicant's prayer for cancellation of bail. The trial Court shall proceed with the case and if there is any allegation of threatening or tempering witnesses of the prosecution it will always be open for the applicant to take appropriate remedy against the respondent.
