Agrawal Order On Board /0 2 /201 (1) The accused/applicant has preferred this third bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No.274/2013 registered at Police Station Gandhi Nagar, Ambikapur, District Surguja (C.G.) for the offences punishable under Sections 302 read with Section 34 of the Indian Penal Code.

(2) The applicant's first bail application was dismissed on merits by order of this Court dated 24.08.2015 passed in M.Cr.C. No.4210/2015.

(3) The applicant's second bail application was also dismissed on merits by order of this Court dated 01.02.2016 passed in M.Cr.C. No.805/2016.

(4) Having heard counsel for the parties, having regard to the facts & circumstances of the case; I do not find any change in circumstances to entertain this third bail application. Thus, the bail application is rejected.
