1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.125/2015, registered at Police Station Bhatapara (R), Distt. BalodabazarBhatapara, for the offence punishable under Sections 376 of the IPC, 4 and 6 of the Protection of Children from Sexual Offences Act, 2012.

2. This is the second bail application filed on behalf of the applicant for grant of regular bail. First bail application has been dismissed as withdrawn with liberty to repeat after examination of material prosecution witnesses, vide order dated 9-9-2015 passed by this Court in M.Cr.C.No.4696/2015.

3. Learned counsel for the applicant seeks to withdraw this application also.
